Terms of Service

By accessing or using EVIZ ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.

EVIZ operates as a peer-to-peer marketplace platform connecting charging station owners ("Hosts") with electric vehicle drivers ("Renters"). EVIZ does not own, operate, control, or maintain any charging stations listed on the Platform.

EVIZ is a Marketplace Platform Only

• EVIZ provides a technology platform to connect Hosts and Renters
• EVIZ is not a party to any transaction or agreement between Hosts and Renters
• All charging station bookings are contracts directly between Hosts and Renters
• EVIZ does not own, operate, maintain, or control charging equipment
• EVIZ does not guarantee the safety, legality, or quality of any charging station

No Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. EVIZ DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

As a Host, you are solely responsible for:

• Ensuring you have the legal right and authority to list and share your charging equipment
• Compliance with all local, state, and federal laws, regulations, zoning requirements, and HOA/condo association rules
• Obtaining any necessary permits, approvals, or licenses from government authorities
• Notifying your property insurance provider and maintaining adequate liability coverage
• Understanding and complying with your utility company's policies regarding electricity sharing or resale
• Maintaining charging equipment in safe, properly functioning, and code-compliant condition
• Ensuring electrical installations meet all applicable building and electrical codes
• Providing accurate information about your station, equipment, location, and availability
• Reporting all rental income to appropriate tax authorities
• Any property damage, personal injury, or death arising from use of your charging station

Host Liability and Indemnification

HOSTS AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS EVIZ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING FROM:

• Hosting a charging station on the Platform
• Equipment malfunction, failure, or safety issues
• Electrical problems, fires, shocks, or other hazards
• Property damage or personal injury to Renters or third parties
• Violation of laws, regulations, permits, or HOA rules
• Insurance coverage disputes or gaps
• Tax obligations or reporting requirements

As a Renter, you agree to:

• Use charging stations only during your confirmed booking time
• Follow all Host instructions, property rules, and safety guidelines
• Respect Host property, equipment, and neighboring properties
• Use equipment properly and safely according to manufacturer specifications
• Pay all fees including overstay charges, damage fees, or penalties
• Report any equipment issues, safety concerns, or hazards immediately
• Not tamper with, modify, or misuse charging equipment

Renter Liability and Indemnification

RENTERS AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS EVIZ FROM ANY CLAIMS ARISING FROM THEIR USE OF CHARGING STATIONS, INCLUDING PROPERTY DAMAGE, EQUIPMENT DAMAGE, PERSONAL INJURY, OR VIOLATIONS OF HOST RULES OR LOCAL LAWS.

Hosts set their own pricing for the service of providing access to their charging equipment. This pricing model is designed to cover the Host's costs and time, not to constitute the retail sale of electricity, which is regulated differently under Canadian law.

Electricity Sharing Compliance

EVIZ facilitates peer-to-peer sharing of charging access. Hosts are responsible for understanding and complying with their utility company's policies regarding electricity sharing, resale, or sub-metering.

Hosts may structure their pricing as "parking with charging access," "service fees," or other models compliant with local utility regulations. EVIZ does not provide legal advice regarding utility policies.

EVIZ IS NOT RESPONSIBLE FOR ANY VIOLATIONS OF UTILITY POLICIES, REGULATIONS, OR ELECTRICITY RESALE LAWS. HOSTS ARE SOLELY RESPONSIBLE FOR ENSURING THEIR PRICING AND SERVICE MODEL COMPLIES WITH ALL APPLICABLE FEDERAL, PROVINCIAL, AND LOCAL REGULATIONS.

EVIZ charges a platform service fee on each completed booking. The current fee structure is 15% commission on Host earnings.

All payments are processed securely through our third-party payment processor (Stripe). EVIZ does not store payment card information.

Hosts are responsible for all applicable taxes on their income. EVIZ may issue tax forms (such as 1099-K) as required by law.

EVIZ is Not Liable For:

• Property damage, personal injury, or death arising from charging station use
• Equipment malfunction, failure, electrical problems, fires, or safety hazards
• Disputes between Hosts and Renters
• Legal, regulatory, permit, or code compliance violations
• Tax obligations or penalties
• Insurance coverage gaps or claim denials
• Utility policy violations or electricity resale issues
• HOA, condo association, or landlord disputes
• Lost profits, business interruption, or consequential damages
• Theft, vandalism, or criminal activity

Maximum Liability

IN NO EVENT SHALL EVIZ'S TOTAL LIABILITY TO YOU EXCEED THE LESSER OF (A) $100 OR (B) THE AMOUNT OF FEES YOU PAID TO EVIZ IN THE 12 MONTHS PRECEDING THE CLAIM.

No Liability Insurance

While EVIZ may facilitate certain insurance products or services, EVIZ does not provide liability insurance coverage. Hosts are strongly encouraged to maintain appropriate insurance coverage for their property and charging operations.

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS EVIZ, ITS PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING FROM OR RELATED TO:

• Your use of the Platform
• Your listing or booking of charging stations
• Your violation of these Terms
• Your violation of any laws, regulations, or third-party rights
• Any property damage or personal injury caused by you or your equipment
• Disputes with other users

Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes must be brought on an individual basis.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where EVIZ is incorporated, without regard to conflict of law principles.

Renters may cancel bookings according to the cancellation policy displayed at time of booking. Cancellation fees may apply.

Hosts may cancel bookings in emergency situations but may face penalties for frequent cancellations.

Users may not:

• Provide false, misleading, or fraudulent information
• List stations they don't have permission to share
• Use the Platform for illegal purposes
• Harass, threaten, or harm other users
• Attempt to bypass payment systems or avoid fees
• List unsafe, non-functional, or non-compliant equipment
• Violate any laws, regulations, or third-party rights

EVIZ reserves the right to suspend or terminate user accounts for violations of these Terms, fraudulent activity, safety concerns, or at our sole discretion. Users may cancel their accounts at any time.

EVIZ reserves the right to modify these Terms at any time. Users will be notified of significant changes via email or Platform notification. Continued use after changes constitutes acceptance of modified Terms.
